Referral Partner Terms
Last updated: October 2026
These terms outline the general framework of the Trust Life and Annuity LLC referral partner program. The specific terms applicable to any individual referral partner are set forth in a written referral agreement. These terms are provided for informational purposes and do not constitute a binding agreement.
Referral Relationship
Referral partners introduce business owners to Trust Life and Annuity LLC for potential financial consulting services. The referral relationship is governed by a separate written referral agreement signed by both parties. These terms are a general summary only and do not constitute a binding agreement.
Qualified Referrals
A referral qualifies for compensation when all of the following criteria are met: (1) the referred business owner has existing commercial debt obligations; (2) the business owner consents to being contacted; (3) the referred client enrolls in our services and generates a collected fee; and (4) the referral complies with the terms of the written referral agreement.
Compensation
For qualifying referred clients who enroll and generate a collected fee, referral partners may receive 50% of our collected company fee, subject to the written referral agreement and applicable law. The hypothetical example on our Broker Partnerships page is illustrative only and does not represent guaranteed earnings. Actual fees and compensation depend on the individual engagement and fee structure agreed upon.
How Compensation Is Calculated
Compensation is calculated as 50% of the company fee actually collected from the enrolled client. The company fee is determined based on the complexity of the engagement, the types and amounts of obligations involved, and the strategies pursued. Fee rates and structures vary by engagement. The $100,000 debt example with a $6,000 company fee assumes a 6% fee rate — this is illustrative only and actual fee rates may differ.
When Commissions Become Payable
Referral compensation becomes payable when the company fee is collected from the enrolled client. Compensation is not payable for referrals that do not result in enrollment, or for which no company fee is collected.
Conditions, Refunds, and Chargebacks
If a client receives a refund of fees paid, the corresponding referral compensation may be subject to chargeback or repayment. Specific conditions regarding refunds, chargebacks, and repayment obligations are set forth in the written referral agreement.
Documentation
Referral compensation terms are documented in writing. Payments are made according to the written referral agreement, and referral partners receive documentation of applicable referral payments.
Relationship Protection
The intention of the referral program is to address the client's current financial situation while maintaining the relationship with the originating broker. When appropriate, future funding opportunities can be referred back to the originating broker.
Compliance
Referral partners are responsible for complying with all applicable laws and regulations in their jurisdiction, including any requirements related to referrals and compensation. Trust Life and Annuity LLC does not provide legal advice regarding a partner's obligations. Referral compensation arrangements may be subject to state and federal regulations.
Authorization
Referral partners must confirm that the business owner has authorized them to share the owner's information for the purpose of being contacted regarding potential financial solutions.
How to Begin
To begin working with us, a broker or funding professional should contact us through our broker referral form or contact page. We will provide a written referral agreement for review. Once the agreement is executed, the broker may begin submitting referrals.
Changes to Terms
We may update these terms from time to time. Changes will be posted on this page with an updated effective date. The specific terms applicable to any individual referral partner are set forth in the written referral agreement.
Legal Review Required: These Referral Partner Terms are a draft and must be reviewed and finalized by qualified legal counsel before use. The written referral agreement must be separately reviewed to ensure compliance with all applicable laws and regulations, including state and federal regulations governing referral compensation, insurance licensing, and financial services. Do not execute any referral agreement without legal review and owner approval.
